Seems reasonable to me. All they did was block production and get a pittance in damages. Shes already published 1-2 encyclopedias as well so it seems like shes got a fair case of infringement.

She lives in a Castle

A fucking big ass castle.... and this is what she says in court:

She said she was so distressed at the prospect that it would be published that she had stopped work on a new novel. "It's really decimated my creative work over the last month," she said during the trial in April.

If the lexicon is published, she went on, "I firmly believe that carte blanche will be given to anyone who wants to make a quick bit of money, to divert some Harry Potter profits into their own pockets."

I kind of agree that she has a right to protect intellectual property, but is there really a case to be made that this lexicon would cause her damages?

.... Decimated my creative work... yeah... ok... whatever... J.K, go smoke a joint, take a stroll on your grounds, maybe go for a fox hunt or whatever it is you British aristocrats do these days and come back with a fresh head and think of more ways to squeeze every ounce of life out of your Potter creations.

To me this reeks in the same manner as Lucas suing some guy for making storm trooper costumes to be sold at gamer cons.

Well, she is crazy. She was afterall a homeless single mom with serious depression issues when she started writing this shit. Its not like she is a balanced an healthy individual. I can't tell if shes 'Lucas-crazy' or not, but she is at least a little crazy.

But still, the 'damages' of the lawsuit amounted to $7000. Also, she did write two encyclopedia like texts--one of spells and one of monsters I think--which were entirely for charity. Ie. she didn't make any money personally on them. So its hard to imagine that whatever this person was trying to publish didn't have serious creative overlap with books she wrote that aren't even lining her pocket.

I mean, I know IP lawsuits are pretty absurd. But I don't feel a lot of sympathy for the guy that got sued here. Looks like he got little more than a slap on the wrist for trying to compete with works with a strong charitable background.

Sure, the damages awarded

Sure, the damages awarded was a small sum. What really sticks in my craw, though, is that JKR and company pursued this guy as if his book, practically an indie publication, would put so much as a dimple in her Money Bin. You know the people who would buy this guy's Lexicon? It's the very same Harry Potter geeks who already own every single novel and official companions.

Rowling also claimed that this matter distressed her so much that she had to stop writing her next novel. FFS.

some neverminds

I was wrong about her already publishing encyclopedias. She is planning on publishing one, but has not yet.

I read up on the news around this and, prior to this whole affair the author of the disputed text and Rowling had a good relationship. She had been a big fan of his web site. I guess she received an advanced copy of the work and tried to get him to make some changes to make it acceptable. Apparently he refused to make any changes or even discuss the book further, and so he had to be sued.

In any case, sounds like the guy was a cock and deserved to be sued.

Edit: There were two books produced for charity, and they were "quiddich through the ages" and "magical beasts and where to find them".
